10-103. CONSTRUCTION OF TITLE.

THIS TITLE SHALL BE CONSTRUED IN A MANNER CONSISTENT
WITH THE POLICY STATED IN THIS SUBTITLE.

fourth sentence of Article 59, § 2.

10-104. SCOPE OF TITLE.

NOTWITHSTANDING ANY OTHER PROVISION OF LAW, THIS TITLE
APPLIES TO A PERSON WHO IS LICENSED UNDER TITLE 19 OF THIS
ARTICLE IF THE PERSON PROVIDES CARE OR TREATMENT TO
INDIVIDUALS WHO HAVE MENTAL DISORDERS.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59, § 1A.

The phrase "a person who is licensed under Title
19 of this article" is substituted for "hospital
or facilities licensed under the provisions of
Article 43", for clarity.

The phrase "individuals who have mental
disorders" is substituted for "mental patients",
for clarity.

SUBTITLE 2. MENTAL HYGIENE ADMINISTRATION.

10-201. ADMINISTRATION ESTABLISHED.

THERE IS A MENTAL HYGIENE ADMINISTRATION IN THE
DEPARTMENT.

without substantive change from the second clause
of former Article 59, § 4 and rephrased in the
standard language for creation of a unit.

It is set forth as a separate section for
emphasis.
