SUBTITLE AND SUBSECTION (B) OF THIS SECTION, THE GOVERNING
BODY OF EACH COUNTY SHALL ESTABLISH A DRUG ABUSE ADVISORY
COUNCIL FOR THE COUNTY.

(B) INTERCOUNTY ADVISORY COUNCIL.

THE GOVERNING BODIES OF TWO OR MORE COUNTIES MAY
ESTABLISH, BY AGREEMENT, AN INTERCOUNTY DRUG ABUSE ADVISORY
COUNCIL IF:

(1)  THE POPULATION OF ONE OF THE COUNTIES IS TOO
SMALL TO WARRANT THE ESTABLISHMENT OF A DRUG ABUSE PROGRAM
FOR THAT COUNTY; AND

(2)  THE DIRECTOR CONSENTS.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause
of former Article 43B, § 3A(a) and the first
sentence of (b).

In subsection (a) of this section, the former
reference to Baltimore City is deleted as
unnecessary in light of the use of the defined
term "county".

In subsection (b)(2) of this section, the former
reference "with the approval of the Secretary of
Health and Mental Hygiene" is deleted as
unnecessary in light of § 9-203(a) of this title.

9-310. MEMBERSHIP.

(A)  IN GENERAL.

THE GOVERNING BODY OF A COUNTY SHALL APPOINT THE
MEMBERS OF ITS COUNTY ADVISORY COUNCIL, IN THE MANNER THAT
THE GOVERNING BODY DETERMINES.

(B)  INTERCOUNTY ADVISORY COUNCIL.

IF AN INTERCOUNTY ADVISORY COUNCIL IS ESTABLISHED, THE
GOVERNING BODY OF EACH PARTICIPATING COUNTY SHALL APPOINT AT
LEAST 4 MEMBERS OF THE COUNCIL.
