9-308. SCOPE OF PART II.

PART II OF THIS SUBTITLE DOES NOT APPLY TO ANY COUNTY
THAT HAS AN ADVISORY BODY IF THAT BODY:

(1)  EXISTED ON JULY 1, 1979;

(2)   IS ESTABLISHED BY STATUTE OR ORDINANCE; AND

(3)  AS ITS ONLY RESPONSIBILITIES:

(I)  REVIEWS POLICIES AND PROGRAMS FOR THE
TREATMENT OF DRUG ABUSE AND ALCOHOLISM; AND

(II)  MAKES RECOMMENDATIONS TO THE
APPROPRIATE HEALTH OFFICIALS ON THESE POLICIES AND PROGRAMS.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43B, § 3A(c).

In item (2) of this section, the word "statute"
is substituted for "law", to give effect to the
apparent intent of former Article 43B, § 3A(c)
that these councils have a degree of permanence.
This substitution is based on the word
"ordinance", which otherwise would be
unnecessary.

In item (3) of this section, "only
responsibilities" is substituted for "sole
responsibility" to reflect that making
recommendations also is a responsiblity.
