9-305. DUTIES.

(A)  LIMITATION.

THE STATE ADVISORY COUNCIL DOES NOT HAVE ANY EXECUTIVE
OR APPOINTIVE DUTIES.

(B)  DUTIES.

THE STATE ADVISORY COUNCIL SHALL:

(1)  SUBMIT AN ANNUAL REPORT TO THE GOVERNOR, THE
SECRETARY, AND THE GENERAL ASSEMBLY; AND

(2)  ADVISE THE GOVERNOR, THE SECRETARY, AND THE
ADMINISTRATION ON:

(I)  REVISING THE STATE COMPREHENSIVE DRUG
ABUSE CONTROL PLAN;

(II)  PROMOTING, DEVELOPING, ESTABLISHING,
COORDINATING, AND CONDUCTING, IN COOPERATION WITH OTHER
FEDERAL, STATE, LOCAL, OR PRIVATE AGENCIES, UNIFIED PROGRAMS
FOR EDUCATION, PREVENTION, DIAGNOSIS, TREATMENT,
REHABILITATION, AND CONTROL OF DRUG ABUSE; AND

(III)  EVALUATING EXISTING AND PLANNED
PROGRAMS AND FACILITIES OF THE ADMINISTRATION.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43B, § 3(e) and the third sentence of (c).

In subsection (b)(2)(i) of this section, the
former description of the State comprehensive
drug abuse control plan is deleted as unnecessary
in light of § 9-204(c)(3) of this title, which
describes the State plan in detail. This
deletion avoids possible discrepancies between
the 2 descriptions of the State plan, which might
result from amending 1 provision without amending
the other. In this regard, note the references
to "drug addiction" and "drug addicts" in former
Article 43B, § 3(e)(1) and the broader references
to "drug abuse" and "drug abusers" in former
Article 43B, § 5(a).
