(2) OF THE 9 MEMBERS FROM THE GENERAL PUBLIC, AT
LEAST 1 SHALL BE A PROVIDER OF DRUG ABUSE TREATMENT
SERVICES.

(B)  DESIGNATION OF REPRESENTATIVES.

AN EX OFFICIO MEMBER OF THE STATE ADVISORY COUNCIL MAY
DESIGNATE A REPRESENTATIVE TO ACT ON BEHALF OF THAT MEMBER.

(C)  MEMBERSHIP NOT STATE EMPLOYMENT.

A MEMBER OF THE STATE ADVISORY COUNCIL IS NOT A STATE
EMPLOYEE BECAUSE OF THE MEMBERSHIP.

(D)  TENURE; VACANCIES.

(1)  THE TERM OF AN APPOINTED MEMBER IS 3 YEARS
AND BEGINS ON JANUARY 1.

(2)  THE TERMS OF THE APPOINTED MEMBERS ARE
STAGGERED AS REQUIRED BY THE TERMS PROVIDED FOR APPOINTED
MEMBERS OF THE STATE ADVISORY COUNCIL ON JULY 1, 1982. THE
TERMS OF ONE THIRD OF THOSE MEMBERS END EACH YEAR.

(3)  AT THE END OF A TERM, A MEMBER CONTINUES TO
SERVE UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(4)  A MEMBER WHO IS APPOINTED AFTER A TERM HAS
BEGUN SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A
SUCCESSOR IS APPOINTED AND QUALIFIES.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence -- except the first clause of that
sentence -- and the entire third and fourth
sentences of former Article 43B, § 3(a), the
first through third sentences of (b), and the
second sentence of (d).

In subsection (a)(l)(ii) of this section, the
former reference to "permanent" ex officio
members is deleted as redundant.

In subsection (a)(2) of this section, the defined
term "drug abuse" is added to modify "treatment
services", for clarity.
