IMMINENT DANGER OF HAVING A DRUG ADDICTION; OR

(3) SHOWS THE SYMPTOMS OF DRUG ADDICTION.

REVISOR'S NOTE: Item (1) of this subsection is new
language added to state expressly that which
formerly only was implied by the statement that
being in danger of having a drug addiction was
sufficient to constitute being a "drug addict".

Items (2) and (3) of this subsection are new
language derived without substantive change from
former Article 43B, § 2(g)(1).

In item (2) of this subsection, the defined term
"drug addiction" is substituted for the phrase
"addicted to that drug", for clarity.

(H) DRUG ADDICTION.

(1)  "DRUG ADDICTION" MEANS A PHYSICAL AND
PSYCHOLOGICAL DEPENDENCE ON A DRUG.

(2)  "DRUG ADDICTION" DOES NOT INCLUDE TAKING A
DRUG UNDER ACCORDING TO A LAWFUL PRESCRIPTION THAT IS
ISSUED, IN THE COURSE OF PROFESSIONAL TREATMENT, FOR A
LEGITIMATE MEDICAL PURPOSE.

REVISOR'S NOTE: Paragraph (1) of this subsection is new
language derived without substantive change from
former Article 43B, § 2(f).

Paragraph (2) of this subsection is new language
derived without substantive change from former
Article 43B, § 2(g)(2) and rephrased to describe
the action excluded from the scope of this
definition.

In paragraph (1) of this subsection, the defined
term "drug" is substituted for the description of
a "controlled dangerous substance ...", for
brevity.

In paragraph (2) of this subsection, the former
reference to a prescription "issued by a
physician" is deleted since other practitioners
lawfully may issue prescriptions. See the
definition of "authorized prescriber" in HO §
12-101 and the definition of "practitioner" in
Article 27, § 277 of the Code.
