In paragraph (l)(ii) of this subsection, the
defined term "drug dependence" is substituted for
"dependence", for clarity.

In paragraph (2) of this subsection, the former
reference to a prescription "that a physician
issues" is deleted since other practitioners
lawfully may issue prescriptions. See the
definition of "authorized prescriber" in HO §
12-101 and the definition of "practitioner" in
Article 21, § 277 of the Code.

"Drug addiction" § 9-101
"Drug dependence" § 9-101
"Includes"/"including" § 1-101

(F)  DRUG ABUSER.

"DRUG ABUSER" MEANS AN INDIVIDUAL WHO:

(1)  HAS A DRUG DEPENDENCE OR DRUG ADDICTION;

(2)  BECAUSE OF REPEATED USE OF A DRUG, IS IN
IMMINENT DANGER OF HAVING A DRUG DEPENDENCE; OR

(3)  SHOWS THE SYMPTOMS OF DRUG ABUSE.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43B, § 2(e)(1) and (2).

In item (1) of this subsection, the reference to
having a "drug dependence" is new language added
to state expressly that which formerly only was
implied by the statement that being in danger of
having a drug dependence is sufficient to
constitute being a "drug abuser".

In item (2) of this subsection, the defined term
"drug dependence" is substituted for the phrase
"dependent, on the drug", for clarity.
