Persons employed by the Department of Legislative
Reference for at least six consecutive months immediately
prior to July 1, 1974, on a full-time basis, paid per-diem
salary, and serving as either a terminal operator,
supervising terminal operator, proofreader or supervising
proofreader shall be eligible for appointment to a
comparable position in the classified service under this
article without examination or further qualifying
requirement.]
SECTION 2. AND BE IT FURTHER ENACTED, That the
provisions of Section 1 of this Act do not affect the status
of any employee of the Department of Fiscal Services and or
Department of Legislative Reference occupying a classified
position as of the effective date of this Act who on or
before June 30, 1982 elects to remain as a classified
employee after that date in a position which by Section 1 of
this Act becomes could become an unclassified position
unless such individual seeks promotion to an unclassified
position.
SECTION 3. AND BE IT FURTHER ENACTED, That after July
1, 1982 all unclassified employees of the Department of
Legislative Reference and all unclassified and nontenured
employees of the Department of Fiscal Services who are
removed from their positions may have their removal reviewed
by the President of the Senate and the Speaker of the House
of Delegates until the guidelines required by this Act are
adopted by the Legislative Policy Committee.
SECTION 3 4. AND BE IT FURTHER ENACTED, That
sections 48 through 53 of Article 40 of the Code shall be
under the subheading "Legislative, Research, Library,
Computer and Administrative Divisions".
SECTION 4 5. AND BE IT FURTHER ENACTED, That this
Act shall take effect June 1, 1982.
