REGULATED UNDER THE MARYLAND CONTROLLED DANGEROUS SUBSTANCES
ACT.

REVISOR'S NOTE: This subsection is new Language added
to avoid repetition of phrases such as "any
controlled dangerous substance, the use of which
either is prohibited or regulated by §§ 276
through 302 of Article 27".

As to the Maryland Controlled Dangerous
Substances Act, see Article 27, § 276 et seq. of
the Code.

(E) DRUG ABUSE.

(1)  "DRUG ABUSE" MEANS:

(I)  MISUSE OR UNLAWFUL USE OF A DRUG;

(II)  DRUG DEPENDENCE; OR

(III)  DRUG ADDICTION.

(2)  "DRUG ABUSE" DOES NOT INCLUDE TAKING A DRUG
UNDER ACCORDING TO A LAWFUL PRESCRIPTION THAT IS ISSUED, . IN
THE COURSE OF PROFESSIONAL TREATMENT, FOR A LEGITIMATE
MEDICAL PURPOSE.

REVISOR'S NOTE: Paragraph (l)(i) and (ii) of this
subsection is new language derived without
substantive change from former Article 43B, §
2(d).

Paragraph (l)(iii) and (2) of this subsection are
new language derived without substantive change
from former Article 43B, § 2(e)(2) and (3) and
rephrased to describe the actions that constitute
drug abuse.

In paragraph (l)(i) of this subsection, the

defined term "drug" is substituted for the

description of a "controlled dangerous

substance...", for brevity.

Also in paragraph (l)(i) of this subsection,
reference to an "unlawful" use of a drug is
substituted for the ambiguous reference to an
"unauthorized" use.

Also in paragraph (l)(i) of this subsection, the
former reference to "experimentation" is deleted
as overly broad, since there are lawful
experimental uses of drugs, and as otherwise
unnecessary in light of the references to
"misuse" and "unlawful use".
