REVISOR'S NOTE: This section is new Language derived
without substantive change from former Article
2C, § 302(a), the second sentence of (b), and
(c), as that subsection related to State programs
and facilities.

Subsection (a) of this, section is revised to
state affirmatively that this State "shall have"
a State program.

In the introductory phrase of subsection (a)(2)
of this section and in subsection (a)(2)(iii) of
this section, respectively, the former phrases
"at least" and "but not limited to" are deleted
in light of the use of the defined terms
"includes" and "including".

In subsection (b) of this section, the former
requirement that the program be "available to
both males and females" is deleted as misleading,
since the Code of Fair Practices, promulgated as
Executive Order No. 01.01.1970.15, prohibits
discrimination in provision of services and
prohibits State financial assistance to any
recipient who engages in discriminatory
practices, based, not only on sex, but national
origin, race, color, creed, age, marital status,
physical or mental handicap, or political or
religious opinion or affiliation.

The first sentence of former Article 2C, §
302(b), which permitted charges for services, is
deleted as unnecessary in light of Title 16 of
this article, which generally provides for
reimbursement for State funded services.

8-403. CONTRACTS AND LOANS.

(A)  STATE CONTRACTS.'

TO CARRY OUT THE PURPOSES OF THIS TITLE, THIS STATE MAY
CONTRACT WITH ANY APPROPRIATE PUBLIC OR PRIVATE AGENCY THAT
HAS PROPER AND ADEQUATE TREATMENT FACILITIES, PROGRAMS, AND
STAFF.

(B)  REVOLVING FUND.

THE DEPARTMENT MAY CREATE A REVOLVING FUND TO LEND
MONEY, ON THE TERMS THAT THE DEPARTMENT SETS, TO ANY
NONPROFIT CORPORATION IN THIS STATE THAT, AS ITS MAIN
FUNCTION, CARES FOR OR TREATS ALCOHOLICS. HOWEVER, THE
INTEREST RATE ON A LOAN MADE UNDER THIS SUBSECTION MAY NOT
EXCEED 6 PERCENT SIMPLE INTEREST A YEAR.
