[14-8. Prerequisite to exercise of powers.
The Washington Suburban Sanitary Commission shall not
exercise any of the powers conferred upon it by this
subtitle unless and until it shall have entered into a
contract with the Anne Arundel County Sanitary Commission
relating to the execution of the powers, and supplying water
to residents of Anne Arundel County who may be reasonably
served by the construction and operation of the system
authorized by this subtitle.]
COMMITTEE NOTE: Former Article 67, § 14-8, which
required a certain contract to be made before the
WSSC could exercise powers under this title, is
deleted as unnecessary in light of the revision
of § 14-102 of this subtitle.
TITLE 15. WATER SYSTEM IN HOWARD COUNTY.
[15-1] 15-101. Authority of WSSC to furnish water for
Howard County.
The [Washington Suburban Sanitary Commission be and is
hereby authorized and empowered to] WSSC MAY construct,
[reconstruct, extend,] operate, and maintain a water system
[from its present system west of the Town of Laurel] to the
Howard County boundary line [for the purpose of supplying]
TO SUPPLY water to the residents of Howard County.
[15-2] 15-102. Contracts and agreements.
(a) The [Washington Suburban Sanitary Commission shall
have full power and authority to] WSSC MAY enter into any
contract or agreement with the Howard County [Metropolitan
Commission, or its successors,] DEPARTMENT OF PUBLIC WORKS
and[/or with] any person[, firm, corporation or association,
including any private or public service corporation] to
furnish water [from its system authorized to be constructed
under this subtitle or by any other means which the
commission may deem necessary and proper].
COMMITTEE NOTE: The "Howard County Department of Public
Works" is the successor organization to the
"Howard County Metropolitan Commission", and this
subsection and throughout this title references
are updated to reflect this change.
(b) The [Washington Suburban Sanitary Commission
and/or] WSSC, the Howard County [Metropolitan Commission]
DEPARTMENT OF PUBLIC WORKS, and[/or] any person[, firm,
corporation or association, including any private or public
service corporation,] may determine by agreement [from time
to time] the costs, rentals, service charges, or other fees
entered into under [this] THE agreement IN THIS SECTION.
