THE RESIDENTS AND PROPERTY OWNERS OF THE AREA AN
EFFICIENT, OPERATING REGIONAL SERVICE WITH ADEQUATE
FACILITIES FOR DEVELOPMENT AND PROMOTION OF THE SAFETY OF
LIFE AND PROPERTY.

[(b) Except as hereinafter specified, no storm or
surface water drainage system,, or part thereof, and no
connection with an existing system or part thereof, shall be
constructed or installed by any person, firm or corporation
in the Washington Suburban Sanitary District portion of
Prince George's County, except for the City of Bowie, and
that part of Montgomery County in the City of Takoma Park
which remains under the jurisdiction of the Washington
Suburban Sanitary Commission with respect to storm drainage
construction and maintenance under the provisions of the
Storm Drainage Transfer Act (section 3-12), unless the plans
and specifications therefor have first been approved by the
commission. The construction, and maintenance items if any
are required by the permit, shall be in conformity with the
plans and specifications as approved.]

(B) (1) This subsection [shall] DOES not apply to any
[structures] STRUCTURE installed by an individual for the
protection of his home[,] unless [such] THE structure:

(I)   [connects] CONNECTS to a drainage
system or part [thereof] OF A DRAINAGE SYSTEM THAT IS
subject to the [commission's] control OF THE WSSC; or

(II)   [unless such structure is] IS
installed in a drainage easement [theretofore] THAT HAS
PREVIOUSLY BEEN established by plat or other dedication.

(2)  EXCEPT AS PROVIDED IN THIS SECTION, AND
UNLESS THE WSSC FIRST APPROVES THE PLANS AND SPECIFICATIONS
FOR A STORM OR SURFACE WATER DRAINAGE SYSTEM, A PERSON MAY
NOT CONSTRUCT OR INSTALL A STORM OR SURFACE WATER DRAINAGE
SYSTEM OR PART OF A SYSTEM OR A CONNECTION TO AN EXISTING
SYSTEM OR PART OF A SYSTEM.

(3)  THE CONSTRUCTION AND, IF REQUIRED BY THE
PERMIT, MAINTENANCE ITEMS . FOR A STORM OR SURFACE WATER
DRAINAGE SYSTEM UNDER PARAGRAPH (1) OF THIS SUBSECTION SHALL
CONFORM TO THE APPROVED PLANS AND SPECIFICATIONS FOR THE
SYSTEM.

(4)   [Where] IF, under the provisions of this
section, a permit and approval for construction is required
or was required at the time of the construction, and a storm
drainage system or part [thereof] OF A STORM DRAINAGE SYSTEM
is or was constructed without the required permit and
approval, the [commission, upon ascertainment] WSSC, ON
LEARNING of the illegal construction, may require the owner
or the [party] PERSON who constructed the drain, or the
[party] PERSON who is then responsible for the drain[,]:
