bonding authority as provided in [Chapter] TITLE 4 of this
article.

(2) Payment of the bonds shall be in accordance
with § [3-ll(h)] 3-206(g) of this [article] SUBTITLE.

[3-9.] 3-204. Private contributions toward cost of project.

(a) (1) [The commission, or after June 30, 1968 in
Montgomery County, except for that portion of the City of
Takoma Park now situated in Montgomery County, the county
council, or after July 1, 1978, the governing body of the
City of Bowie, with respect to those portions of the city
which had been under the jurisdiction of the Washington
Suburban Sanitary Commission prior to July 1, 1978, for
purposes of storm and surface water drainage control, may
require any owner or developer of a subdivision or tract of
land upon which dwellings, apartments, stores or other
buildings, are to be erected to contribute what it deems to
be a fair share of the cost of a drainage project before it
approves or constructs such project,] THE WSSC MAY REQUIRE
ANY OWNER OR DEVELOPER OF A SUBDIVISION OR TRACT OF LAND ON
WHICH DWELLINGS, APARTMENTS, STORES, OR OTHER BUILDINGS ARE
TO BE ERECTED TO CONTRIBUTE WHAT THE WSSC DETERMINES TO BE A
FAIR SHARE OF THE COST OF A DRAINAGE PROJECT IN THE WSSC'S
JURISDICTION BEFORE THE WSSC APPROVES OR CONSTRUCTS THE
PROJECT.

(2)  THE CITY OF BOWIE HAS THE AUTHORITY PROVIDED
IN PARAGRAPH (1) OF THIS SUBSECTION WITH RESPECT TO THOSE
PORTIONS OF THE CITY OF BOWIE THAT HAD BEEN UNDER THE
JURISDICTION OF THE WSSC BEFORE JULY 1, 1978 FOR PURPOSES OF
STORM AND SURFACE WATER DRAINAGE CONTROL.

(3)  IN MONTGOMERY COUNTY, EXCEPT FOR PROPERTY IN
THAT PORTION OF THE CITY OF TAKOMA PARK IN MONTGOMERY
COUNTY, THE MONTGOMERY COUNTY COUNCIL MAY REQUIRE ANY OWNER
OR DEVELOPER OF A SUBDIVISION OR TRACT OF LAND ON WHICH
DWELLINGS, APARTMENTS, STORES, OR OTHER BUILDINGS ARE TO BE
ERECTED TO CONTRIBUTE WHAT THE COUNTY COUNCIL DETERMINES TO
BE A FAIR SHARE OF THE COST OF A DRAINAGE PROJECT IN THE
COUNTY'S JURISDICTION BEFORE THE COUNTY COUNCIL APPROVES THE
PROJECT FOR CONSTRUCTION.

(4)  [such] BEFORE CONSTRUCTION BEGINS THE
contribution [to] SHALL be paid in cash OR SECURED [before
construction begins or secured] to the satisfaction of the
[commission; and the commission] APPROVING AUTHORITY.

(B) (1) EXCEPT AS PROVIDED IN PARAGRAPHS (2) AND (3)
OF THIS SUBSECTION, THE WSSC may construct any part of any
approved drainage project, [provided] IF the [person or
company interested] INTERESTED PERSON contributes [not less
than] AT LEAST one-half of the cost [thereof] OF THE
PROJECT.
