[1-10.] 1-207. Zoning map applications.
(A) IN THIS SECTION "DISTRICT COUNCIL" INCLUDES A
DESIGNEE OR HEARING OFFICER APPOINTED BY THE DISTRICT
COUNCIL.
(B) Every application for amendment to the zoning map
of the regional district located within Prince George's and
Montgomery Counties may be referred by the respective
district council [or by its designee, including any hearing
examiner appointed by the council,] to the [commission] WSSC
for its review and comment.
(C) The [commission] WSSC shall review each
application [so] referred to it and SHALL [comment] REPORT
[thereon,] in writing ON EACH APPLICATION, to the
appropriate district council[, designee or hearing examiner
not later than fifteen] NOT LESS THAN 15 days [prior to]
BEFORE the regularly scheduled public hearing on the
application.
[The commission's report shall discuss the application as it
would affect any existing or proposed sewer or water
facilities or any other facilities under the jurisdiction of
the commission.]
(D) The report shall include [, but not be limited
to,] an analysis of the probable impact [upon] ON existing
and proposed sewer or water or other facilities under the
jurisdiction of the [commission] WSSC in terms of treatment
facilities, sewer lines of both program and
less-than-program size, their respective design capacity and
present volume flow to capacity relationship, construction
schedules, and any proposed projects under the six-year
capital improvements program or ten-year water and sewerage
plan[; provided, however, that with].
(E) (1) WITH respect to any referred application, the
[commission] WSSC shall provide any supplemental information
which may be requested by the district council[, its
designee or hearing examiner,] not [later than fifteen] LESS
THAN 15 days [prior to] BEFORE the regularly scheduled
public hearing on the application or within [fifteen] 15
days after receipt of the request by the [commission] WSSC,
whichever is later[; and provided further, that upon].
(2) ON request of the district council[, its
designee or hearing examiner, the commission], THE WSSC
shall make [available members of its] staff [or employees]
AVAILABLE to appear before the district council[, its
designee or hearing examiner,] with respect to the
information which the [commission] WSSC is required to
provide under this section.
