A CHRONIC ALCOHOLIC WHO HAS BEEN FOUND TO HAVE A MENTAL
DISORDER IS SUBJECT TO THE LAWS THAT APPLY TO INDIVIDUALS
WITH MENTAL DISORDERS, ALTHOUGH THE INDIVIDUAL SHALL RECEIVE
THE TREATMENT FOR ALCOHOLISM THAT IS CONSIDERED DESIRABLE TO
TREAT THE MENTAL DISORDER.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
2C, § 308.

References to an individual with a "mental
disorder" are substituted for "mentally ill" to
conform to the terminology used in Title 10 of
this article, which contains the Maryland Mental
Hygiene Law. See also Title' 12 of this article,
which provides for criminal cases.

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that, under subsection (b) of this section, an
individual would not receive treatment for
alcoholism if the treatment would not improve the
mental disorder.

SUBTITLE 2. ALCOHOLISM CONTROL ADMINISTRATION.

8-201. ADMINISTRATION ESTABLISHED.

THERE IS AN ALCOHOLISM CONTROL ADMINISTRATION IN THE
DEPARTMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first
sentence of former Article 2C, § 301(a).

It is set forth as a separate section for
emphasis.

8-202. DIRECTOR OF ADMINISTRATION.

(A) POSITION AND APPOINTMENT.

THE HEAD OF THE ADMINISTRATION IS THE DIRECTOR OF
ALCOHOLISM CONTROL, WHO SHALL BE APPOINTED BY THE SECRETARY.

(B) RESPONSIBILITY TO SECRETARY.

THE DIRECTOR SERVES AT THE PLEASURE OF THE SECRETARY.

(C) QUALIFICATIONS.
