In item (3) of this section, the reference to
"welfare" procedures is added to conform to the
references in items (4) and (5)(ii) of this
section.

Also in item (3) of this section, the defined
term "chronic alcoholic{s}" is substituted for
the reference to "chronic inebriates", for
clarity.

In item (6) of this section, the reference to
"intoxication" is substituted for "drunkenness",
for clarity.

In item (8) of this section, the reference to
being taken "to a health facility for
treatment" is substituted for the reference to
being taken "to a private health facility, or to
a public health facility for ... treatment", to
clarify that treatment is to be available at
either the public or private facility.

8-103.

CONSTRUCTION OF TITLE.

(A) CONSISTENT WITH FINDINGS.

THIS TITLE SHALL BE CONSTRUED IN A MANNER CONSISTENT
WITH THE FINDINGS STATED IN THIS SUBTITLE.

(B) RECOGNITION.

EACH PUBLIC OFFICER IN THIS STATE SHALL RECOGNIZE THESE
FINDINGS.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second
sentence of former Article 2C, § 102(i).

References to "findings" are substituted for the
reference to "policy", to conform to § 8-102 of
this subtitle.

8-104. SCOPE OF TITLE.

(A) IN GENERAL.

THIS TITLE APPLIES TO A CHRONIC ALCOHOLIC WHO HAS NOT
BEEN FOUND TO HAVE A MENTAL DISORDER UNDER THE LAWS THAT
RELATE TO THE DETERMINATION OF MENTAL DISORDERS.

(B) APPLICATION OF MENTAL HEALTH LAWS.
