7-203. AUTHORITY OF SECRETARY OVER ADMINISTRATION.

(A)  IN GENERAL.

THE DIRECTOR EXERCISES THE POWERS, DUTIES, AND
RESPONSIBILITIES OF OFFICE SUBJECT TO THE AUTHORITY OF THE
SECRETARY.

(B)  POWERS AND DUTIES.

THE SECRETARY MAY EXERCISE ANY POWER OR PERFORM ANY
DUTY OR RESPONSIBILITY OF THE DIRECTOR.

REVISOR'S NOTE: This section formerly appeared as the
last sentence of Article 59A, § 7.

In subsection (a) of this section, the former
reference to "subordinates" of the Director is
deleted as unnecessary since a subordinate would
exercise only the power delegated.

In subsection (b) of this section, the former
phrase "in his discretion" is deleted as
unnecessary in light of the word "may".

The only other changes are in style.

7-204. GENERAL POWERS AND DUTIES OF DIRECTOR.

(A) IN GENERAL.

IN ADDITION TO THE POWERS AND DUTIES SET FORTH
ELSEWHERE IN THIS TITLE, THE DIRECTOR HAS THE POWERS,
DUTIES, AND RESPONSIBILITIES SET FORTH IN THIS SECTION.

REVISOR'S NOTE: This subsection is new language added
to indicate clearly that the powers and duties
enumerated in this section are not exclusive.

Former Article 59A, § 8(m), which provided that
the Director has the responsibilities assigned
"by State law, executive order or the Secretary",
is deleted as unnecessary.
