(B)  SUPERVISORY RESPONSIBILITIES.

THE DIRECTOR IS RESPONSIBLE FOR SUPERVISING THE CUSTODY
AND TREATMENT OF MENTALLY RETARDED INDIVIDUALS AND FOR THE
PROGRAMS FOR MENTALLY RETARDED INDIVIDUALS.

REVISOR'S NOTE: This subsection is new language that
combines, without substantive change, the first
clause of the first sentence of former Article
59A, § 4(a) and the first clause of § 5.

This subsection is revised as responsibilities of
the Director, rather than the Administration, to
conform to the rest of this section.

The former reference to "care" is deleted as
unnecessary in light of the use of the defined
term "treatment".

Defined terms: "Director" § 7-101
"Mentally retarded individual" § 7-101
"Treatment" § 7-101

(C)  ORGANIZATION OF ADMINISTRATION.

(1)  THE DIRECTOR SHALL:

(I)  ORGANIZE AND MANAGE THE ADMINISTRATION
IN A MANNER THAT WILL ENABLE IT BEST TO DISCHARGE ITS
DUTIES; AND

(II)  APPOINT THE NUMBER OF DEPUTY
DIRECTORS, ASSISTANT DIRECTORS, AND ADMINISTRATIVE HEADS
PROVIDED IN THE STATE BUDGET.

(2)  THE DIRECTOR MAY ASSIGN TO ANY SUBORDINATE
UNIT OR INDIVIDUAL IN THE ADMINISTRATION ANY FUNCTION THAT
IS IMPOSED BY LAW ON THE DIRECTOR.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
59A, § 8(a), (b), and (j).

In paragraph (l)(i) of this subsection, the
former reference to duties assigned "by law and
by the Secretary" is deleted as unnecessary.

In paragraph (l)(ii) of this subsection, the term
"administrative heads" is substituted for
"superintendents", for clarity. The references
to that position in former Article 59A included
"director", "administrator", "chief
administrator", "programs or facility director",
and "'superintendent". In this title,
"administrative head" is used consistently.
