Ch. 442

80C.

(A)  PRIOR TO ENTRY INTO MARYLAND WITH MIGRANT
AGRICULTURAL WORKERS FOR AGRICULTURAL EMPLOYMENT, OR THE
RECRUITMENT OF MIGRANT AGRICULTURAL WORKERS IN THIS STATE,
EVERY FARM LABOR CONTRACTOR SHALL DISCLOSE IN WRITING THE
FOLLOWING INFORMATION TO EACH WORKER:

(1)  THE PLACE OR PLACES OF EMPLOYMENT IN THIS
STATE, INCLUDING A DESCRIPTION OF THE CROPS AND KIND OF
ACTIVITIES INVOLVED;

(2)  THE TERMS AND CONDITIONS OF EMPLOYMENT AT
EACH PLACE, INCLUDING A STATEMENT AS TO THE WAGE RATES TO BE
PAID, THE PERSON MAKING PAYMENT, AND WHEN WAGES ARE DUE;

(3)  THE TRANSPORTATION, HOUSING, AND INSURANCE,
IF ANY, TO BE PROVIDED AND ANY COSTS TO BE CHARGED FOR EACH
OF THEM; AND

(4)  THE EXISTENCE OF ANY LABOR DISPUTE AT THE
PLACE OF EMPLOYMENT KNOWN BY THE FARM LABOR CONTRACTOR.

(B)  IF A FARM LABOR CONTRACTOR FURNISHES HOUSING FOR
MIGRANT AGRICULTURAL WORKERS, EITHER BY AGREEMENT WITH AN
AGRICULTURAL EMPLOYER OR AGRICULTURAL ASSOCIATION, OR
OTHERWISE, HE SHALL ENSURE THAT THE TERMS AND CONDITIONS OF
OCCUPANCY, IF ANY, ARE POSTED IN A CONSPICUOUS PLACE
THROUGHOUT THE DURATION OF THE STAY.

(C)  EVERY FARM LABOR CONTRACTOR SHALL KEEP AND
MAINTAIN RECORDS OF WAGES OWED AND PAID EACH WORKER FOR WORK
PERFORMED IN MARYLAND, WHETHER OR NOT HE IS RESPONSIBLE FOR
MAKING PAYMENT TO THE WORKER, AS MAY BE REQUIRED BY
REGULATION OF THE COMMISSIONER.

(D)  EVERY FARM LABOR CONTRACTOR SHALL PROVIDE
INFORMATION REQUIRED BY THIS SECTION IN WRITING. THIS
INFORMATION SHALL BE PROVIDED IN ENGLISH OR, AS NECESSARY
AND REASONABLE, IN SPANISH OR ANOTHER LANGUAGE COMMON TO
MIGRANT AGRICULTURAL WORKERS WHO ARE NOT FLUENT OR LITERATE
IN ENGLISH. ON REQUEST, THE COMMISSIONER SHALL MAKE
AVAILABLE TO THE FARM LABOR CONTRACTOR FORMS IN ENGLISH OR,
AS NECESSARY AND REASONABLE, SPANISH, OR OTHER LANGUAGE, TO
BE USED IN PROVIDING WORKERS WITH INFORMATION REQUIRED UNDER
THIS SECTION.

(E)  EVERY FARM LABOR CONTRACTOR SHALL COMPLY, UNLESS
THERE IS JUST CAUSE FOR NONCOMPLIANCE, WITH THE TERMS OF:

(1) ANY WRITTEN AGREEMENTS MADE WITH AN
AGRICULTURAL EMPLOYER OR AN AGRICULTURAL ASSOCIATION
PERTAINING TO ANY CONTRACTING ACTIVITY OR WORKER PROTECTION
UNDER THIS SUBTITLE; AND
