relating to vision and hearing tests; and generally
relating to the hearing and vision screenings for all
students in the public schools, certain private
schools, and certain nonpublic education facilities
approved as special education facilities.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article - Education

7-403.

(a)  (1) Each county board or county health department
shall provide hearing and vision [screening tests]
SCREENINGS for all students in the public schools.

(2) Each county health department shall provide
and fund hearing and vision [tests] SCREENINGS for all
students:

(i) In any private school that has
received a certificate of approval under § 2-206 of this
article; and

(ii) In any nonpublic educational facility
in this State approved as a special education facility by
the Department.

(b)  (1) Unless evidence is presented that a student
has been tested within the past year, the [tests] SCREENINGS
required under subsection (a) of this section shall be given
in the year THAT a student enters a school system, ENTERS
THE FIFTH FOURTH, FIFTH, OR SIXTH GRADE, and [when he]
enters the ninth grade.

(2) Further [testing] SCREENING shall be done in
accordance with the bylaws adopted by the State Board.

(c)  The results of the hearing and. vision [tests]
SCREENINGS required by this section shall be:

(1)  Made a part of the permanent record file of
each student; and

(2)  Given to the parents of any student who
fails the [tests] SCREENINGS.
