FOR the purpose of removing the 1-year altering the
limitation period within which the Secretary of Health
and Mental Hygiene may grant rebates under certain
conditions for certain portions of civil penalties
imposed through settlement agreements under the Air
Quality Control Act.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland

(as enacted by Chapter ___(H.B./S.B. ____) of the Acts of

the General Assembly of 1982) read(s) as follows:

(c) If, [within 1 year] WITHIN 36 MONTHS after a civil
penalty is imposed COMPROMISED AND SETTLED under this
section, the person against whom the penalty is imposed
satisfies the Secretary that the violation has been
eliminated or the order or plan for compliance has been
satisfied, the Secretary, with the concurrence of the
Attorney General, may return to the person not more than 75
percent of the amount of the penalty paid.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.
