SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 70B - Office on Aging

7.

(I) "PROCESSING FEE" MEANS THOSE COSTS INCURRED BY THE
PROVIDER IN DETERMINING THE FINANCIAL, MENTAL, AND PHYSICAL
ELIGIBILITY OF AN APPLICANT FOR ENTRANCE INTO A FACILITY.

14.

(a)     A subscriber shall have the right to rescind a
continuing care agreement for any reason prior to the date
of occupancy by the said subscriber.

(b) In the event a subscriber dies or rescinds the
continuing care agreement for any reason, UNDER SUBSECTION
(A) OF THIS SECTION, prior to occupying his unit, the
agreement is automatically canceled and the subscriber or
his legal representative shall receive a full refund of all
moneys paid to the facility except [those]:

(1) THOSE costs specifically incurred by the
facility at the request of the subscriber and set forth in
writing in a separate addendum to the agreement and signed
by the subscriber; AND

(b) (1) IF, PRIOR TO THE SUBSCRIBER OCCUPYING A UNIT,
THE SUBSCRIBER DIES, THE PROVIDER DETERMINES THAT THE
SUBSCRIBER IS INELIGIBLE FOR ENTRANCE INTO; THE FACILITY, OR
THE SUBSCRIBER ELECTS TO TERMINATE THE CONTINUING CARE
