11-417. EVIDENTIARY PRESUMPTION.

THERE IS A PRESUMPTION THAT A PERSON INTENDS TO SELL
ANY BEDDING, UPHOLSTERED FURNITURE, OR FILLING MATERIAL THAT
THE PERSON POSSESSES IN THE COURSE OF BUSINESS.

PART IV. DISINFECTION; TAGS.

11-420. DISINFECTION PROCESS.

(A)  REQUIREMENT FOR APPLYING PROCESS.

A DISINFECTOR MAY NOT USE ANY DISINFECTION PROCESS THAT
IS NOT APPROVED BY AND REGISTERED WITH THE DEPARTMENT.

(B)  CERTIFICATE OF APPROVAL.

THE DEPARTMENT SHALL ISSUE A CERTIFICATE OF APPROVAL
FOR EACH APPROVED DISINFECTION PROCESS.

(C)  POSTING.

A DISINFECTOR SHALL POST THE CERTIFICATE OF APPROVAL
NEAR THE DISINFECTION EQUIPMENT.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 67C(a) and the first and second sentences
of (b).

The references to "certificate of approval" are
added to conform to practice.

In subsection (c) of this section, the reference
to "a disinfector" is added to clarify who has
the duty to post a "certificate of approval".

The term "disinfector" is substituted for the
term "person", to conform to the fact that only a
licensed disinfector may "disinfect" under this
subtitle. See § ll-405(a) of this subtitle.
