PART III. INSPECTION; EVIDENTIARY PRESUMPTION.
11-416. INSPECTIONS.

(A)  GENERAL DUTY.

TO SAFEGUARD THE HEALTH, SAFETY, AND GENERAL WELFARE OF
THE PUBLIC, THE SECRETARY SHALL MAKE INSPECTIONS TO
ADMINISTER AND ENFORCE THIS SUBTITLE.

(B)  PLACES SUBJECT TO INSPECTION.

AT ANY REASONABLE TIME, THE SECRETARY OR A
REPRESENTATIVE OF THE SECRETARY MAY ENTER AND INSPECT ANY
PLACE WHERE:

(1) BEDDING OR UPHOLSTERED FURNITURE IS MADE OR
RENOVATED;

(2) BEDDING, BEDDING COMPONENT PARTS, OR FILLING
MATERIAL IS MADE OR DISINFECTED; OR

(3) BEDDING, UPHOLSTERED FURNITURE, OR FILLING
MATERIAL IS SOLD.

(C)  OBJECTS SUBJECT TO INSPECTION.

DURING AN INSPECTION MADE UNDER THIS SECTION, THE
SECRETARY OR A REPRESENTATIVE OF THE SECRETARY MAY OPEN,
EXAMINE, RESTRICT THE SALE OF, OR SEIZE AND HOLD FOR
EVIDENCE ANY OBJECT THAT THE SECRETARY BELIEVES IS MADE,
SOLD, OR HELD IN VIOLATION OF THIS SUBTITLE.

(D)  INTERFERING PROHIBITED.

A PERSON MAY NOT INTERFERE WITH ANY INSPECTION UNDER
THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, §§ 67A(h) and 67F.

Throughout this section, "Secretary" is
substituted for the references to the Department.
The provisions of former Article 43, §§ 67A(h)
and 67F treated "Department" as a synonym for
"Secretary" and this revision simply makes that
aspect of the law clear.

In subsection (a) of this section, the phrase
"administer" is substituted for the term
"determine compliance with".

In subsection (b) of this section, the defined
