The former requirement that pharmacists keep
prescriptions for at least 2 calendar years
immediately following the date of the last
filling or refilling is deleted as unnecessary in
light of the prescription recordkeeping
requirements of the Health Occupations Article.

The only other changes are in style.

4-1107. PROHIBITED ACTS INVOLVING BARBITURATES.

(A)  DELIVERY OF BARBITURATE.

EXCEPT AS PROVIDED IN § 4-1105(B) OF THIS SUBTITLE, A
PERSON MAY NOT DELIVER A BARBITURATE UNLESS THE BARBITURATE:

(1)  IS DELIVERED BY A PHARMACIST ON A
PRESCRIPTION; AND

(2)  IS IN A CONTAINER THAT BEARS A LABEL THAT
INCLUDES THE FOLLOWING:

(I)  THE NAME AND ADDRESS OF THE OWNER OF
THE ESTABLISHMENT FROM WHICH THE BARBITURATE WAS DELIVERED.

(II)  THE DATE ON WHICH THE PRESCRIPTION
FOR THE BARBITURATE WAS FILLED.

(III)  THE NUMBER OF THE PRESCRIPTION AS
FILED IN THE PRESCRIPTION FILES OF THE PHARMACIST.

(IV)  THE NAME OF THE PRACTITIONER WHO
PRESCRIBED THE BARBITURATE.

(V)  THE NAME AND ADDRESS OF THE PATIENT,
IF CONTAINED IN THE PRESCRIPTION, AND, IF THE BARBITURATE
WAS PRESCRIBED FOR AN ANIMAL, THE SPECIES OF THE ANIMAL.

(VI)  THE DIRECTIONS FOR THE USE OF THE
BARBITURATE AS CONTAINED IN THE PRESCRIPTION.

(B)  REFILLING PRESCRIPTION.

A PERSON MAY NOT REFILL ANY PRESCRIPTION FOR A
BARBITURATE EXCEPT IN ACCORDANCE WITH THE ORIGINAL
PRESCRIPTION OR BY ORAL AUTHORIZATION BY THE PRACTITIONER,
WHICH IMMEDIATELY SHALL BE PUT IN TO WRITING AND FILED BY
THE PHARMACIST.

(C)  DELIVERY OF PRESCRIPTION.

A PERSON MAY NOT DELIVER ANY PRESCRIPTION FOR A
BARBITURATE UNLESS THE PHARMACIST WHO FILLS THE PRESCRIPTION
