4-1101. DEFINITIONS.

(A)  IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

REVISOR'S NOTE: This subsection is new language used as
the standard introductory language to a
definition section.

(B)  BARBITURATE.
"BARBITURATE" MEANS:

(1)  A SALT OR DERIVATIVE OF BARBITURIC ACID,
ALSO KNOWN AS MALONYLUREA, THAT HAS A SLEEP INDUCING ACTION;
OR

(2)  A COMPOUND OF ANY PREPARATION OR MIXTURE OF
THESE.

REVISOR'S NOTE: This subsection formerly appeared as
Article 43, § 284(a).

The words "sleep inducing" are substituted for
"hypnotic or somnifacient" for clarity.

The only other changes are in style.

(C)  DELIVERY.

"DELIVERY" INCLUDES SELLING, DISPENSING, GIVING AWAY,
AND SUPPLYING IN ANY OTHER MANNER.

(D)  MANUFACTURER.

(1)  "MANUFACTURER" MEANS A PERSON WHO:

(I)  IS NOT A PHARMACIST; AND

(II)  MANUFACTURES BARBITURATES.

(2)  "MANUFACTURER" INCLUDES A PERSON WHO
PREPARES BARBITURATES IN DOSAGE FORMS BY MIXING,
COMPOUNDING, ENCAPSULATING, ENTABLETING, OR OTHER PROCESS.
