(1)  DETAIN AND TAKE ANY' NECESSARY ACTION ON ANY
SHIPMENT OF SHELLFISH OR ANY FOOD THAT CONTAINS SHELLFISH
THAT IS IMPORTED INTO THIS STATE IF THE SHELLFISH INVOLVED
IS FROM AN UNKNOWN OR UNCERTIFIED SOURCE; AND

(2)  CONDEMN AND DESTROY ANY SHELLFISH OR ANY
FOOD THAT CONTAINS SHELLFISH THAT IS IMPORTED INTO THIS
STATE IF THE SHELLFISH INVOLVED IS FROM AN UNCERTIFIED
SOURCE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 228A(c) and (d).

In item (1) of this section, "unknown" is
substituted for "questionable" for clarity.

4-1010. CHICORY.

A PERSON MAY NOT SELL COFFEE MIXED WITH CHICORY UNLESS:

(1)  THE PACKAGE CONTAINING THE MIXTURE BEARS THE
WORDS "COFFEE AND CHICORY", IN LETTERS OF THE SAME STYLE
AND SIZE, AND A STATEMENT OF THE NET WEIGHT OF THE PACKAGE
CONTENTS;

(2)  THE MIXTURE CONTAINS NO CEREAL OR OTHER
ADULTERANT; AND

(3)  IF THE MIXTURE IS SOLD IN BEVERAGE FORM IN A
HOTEL OR RESTAURANT, THERE IS DISPLAYED IN A PROMINENT PLACE
A SIGN, WITH LETTERS EASILY LEGIBLE TO THE PATRONS, STATING
THAT THE COFFEE SOLD IS MIXED WITH CHICORY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 495.

GENERAL REVISOR'S NOTE:

Former Article 43, § 498, which dealt with the
disposition of fines collected for violations of this
section, is deleted as unnecessary in light of other,
independent provisions of law.
