(1) EXCEPT AS PROVIDED IN PARAGRAPH (2) OF THIS
SUBSECTION, A PERSON MAY NOT OPERATE A CANNERY OR FROZEN
FOOD PROCESSING PLANT WITHOUT A LICENSE.
(2) IF THE SECRETARY BELIEVES THAT A PERSON IS
OPERATING A CANNERY OR FROZEN FOOD PROCESSING PLANT WITHOUT
A LICENSE, THE SECRETARY SHALL GIVE THE PERSON NOTICE, BY
REGISTERED MAIL, THAT THE PERSON HAS 10 DAYS IN WHICH TO
OBTAIN A LICENSE.
(B) OPERATING CANNERY OR FROZEN FOOD AFTER SUSPENSION
OR REVOCATION OF LICENSE.
IF A LICENSE ISSUED UNDER THIS SUBTITLE IS SUSPENDED OR
REVOKED, THE PERSON WHOSE LICENSE IS SUSPENDED OR REVOKED
MAY NOT DO ANY ACT WITHIN THE SCOPE OF THE SUSPENDED OR
REVOKED LICENSE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the first and
third clauses of the first sentence and the first
half of the first clause of the second sentence
of former Article 43, § 208.
Subsection (b) of this section is revised as a
separate subsection because different penalties
are provided for violating each subsection of
this section. See §§ 4-1205 and 4-1206 of this
article. No substantive change is intended and
the absence in other parts of this article of a
provision similar to subsection (b) of this
section does not imply that, after revocation or
suspension of other licenses governed by this
article, the person whose license is revoked or
suspended is permitted in any way to continue the
activity for which the license was obtained.
The General Assembly may wish to consider
repealing subsection (a)(2) of this section and
the introductory exception clause in subsection
(a)(1) of this section. Most license schemes in
this article, and elsewhere in the Code, prohibit
any person who is neither licensed nor otherwise
authorized from performing any act that is within
the scope of the license, without any provisions
for first notifying that person of the
requirement for a license.
4-625. EMPLOYEES WITH INFECTED WOUND.
AN EMPLOYEE IN A CANNERY OR FROZEN FOOD PROCESSING
PLANT WHO HAS AN INFECTED WOUND ON AN ARM OR HAND MAY NOT:
(1) HANDLE A FOOD PRODUCT; OR
