(House Bill 1825)

AN ACT concerning

Memorial Hospital of Cumberland -
Powers of the Board of Governors

FOR the purpose of amending Chapter 411 of the Acts of 1927,
as amended by Chapter 515 of the Acts of 1970
pertaining to the Board of Governors of the Memorial
Hospital of Cumberland; repealing an archaic provision
of those Acts; authorizing the Board of Governors of
the Memorial Hospital of Cumberland to transfer or
lease all or any part of its assets and liabilities or
obligations; and clarifying the intent of the General
Assembly in relation to the Board of Governors of the
Memorial Hospital of Cumberland.

BY repealing and reenacting, with amendments,

Section 15 of Chapter 411 of the Acts of 1927, as
amended by Section 2 of Chapter 515 of the Acts
of 1929

BY adding to

Chapter 411 of the Acts of 1927, as amended by Chapter
515 of the Acts of 1929 and Chapter 546 of the
Acts of 1970

Section 16

Preamble

WHEREAS, By enactment of Chapter 411 of the General
Assembly in 1927, an entity known as the Board of Governors
of Memorial Hospital was created and empowered to construct,
operate and maintain the Memorial Hospital of Cumberland, to
be financed by bonds issued by the Mayor and City Council of
Cumberland, and to be titled in the name of the Mayor and
City Council of Cumberland; and

WHEREAS, By enactment of Chapter 515 of the Acts of
1929, the Board of Governors of the Memorial Hospital of
Cumberland was declared to be a body politic and corporate
with all powers proper and necessary to operate and manage a
public general hospital, and granted immunity from suit by
reason of the negligence of any employee, servant or agent
engaged in or about the erection, maintenance or operation
of the Memorial Hospital of Cumberland; and
