SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:
Article - Courts and Judicial Proceedings
10-306.
(a) Subject to the provisions of subsection (b), in
any criminal trial in which intoxication [or impairment] due
to the consumption of alcohol, OR BEING UNDER THE INFLUENCE
OF ALCOHOL, is an issue, an official copy of the results of
a chemical test of breath or blood administered by a person
authorized to administer the test, is admissible as
substantive evidence without the presence or testimony of
the technician who administered the test.

WHEREVER "DRIVING WHILE ABILITY IMPAIRED BY CONSUMPTION
OF ALCOHOL" APPEARS IN THE ANNOTATED CODE OF MARYLAND,
"DRIVING WHILE UNDER THE INFLUENCE OF ALCOHOL" SHALL BE
SUBSTITUTED AND HAVE THE SAME MEANING AND EFFECT AS "DRIVING
OR ATTEMPTING TO DRIVE WHILE ABILITY IMPAIRED OR NOT
IMPAIRED BY THE CONSUMPTION OF ALCOHOL."

(a) A police officer who has reasonable grounds to
believe that an individual is or has been driving or
attempting to drive a motor vehicle while intoxicated or
while [the individual's driving ability is impaired by the
consumption of alcohol] UNDER THE INFLUENCE OF ALCOHOL may,
without making an arrest and prior to the issuance of a
citation, request the individual to submit to a preliminary
breath test to be administered by the officer using a device
approved by the State Toxocologist.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.
