CHAPTER 47

(House Bill 249)

AN ACT concerning

Charters - Forfeiture and Revival

FOR the purpose of repealing certain requirements that the
Secretary of State send to the Treasurer and
Comptroller copies of proclamations for forfeiture and
revival of corporate charters and that the Treasurer
and Comptroller record that information.

BY repealing and reenacting, with amendments,

Article - Corporations and Associations

Section 3-505 and 3-506(a)

Annotated Code of Maryland

(1975 Volume and 198l Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article - Corporations and Associations

3-505.

The Secretary of State shall send [copies] A COPY of
the proclamation to the [State Comptroller, State Treasurer,
and the] Department[. They], WHICH shall note on [their
respective] ITS records the facts of the forfeiture of the
charter of each corporation listed in the proclamation and
the revival of those which have been revived.

3-506.

(a) If the Governor is satisfied that a corporation
named in the proclamation has not failed to pay the tax or
file the report within the period specified in § 3-503 of
this subtitle, or that it has been mistakenly reported to
him by the State Comptroller or Department, he may correct
the mistake by filing his proclamation to that effect in the
office of the Secretary of State. The Secretary of State
shall send [copies] A COPY of this proclamation to the
[State Comptroller, State Treasurer, and the] Department.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.
