AN AUDIOLOGIST HAS A GRACE PERIOD OF 30 DAYS AFTER THE
AUDIOLOGIST'S LICENSE EXPIRES IN WHICH TO RENEW IT
RETROACTIVELY, IF THE AUDIOLOGIST:
(1) OTHERWISE IS ENTITLED TO HAVE THE LICENSE
RENEWED; AND
(2) PAYS TO THE BOARD THE RENEWAL FEE AND ANY
LATE FEE SET BY THE BOARD.
REVISOR'S NOTE: This section is new language derived in
part from the third sentence of Art. 43, §
795(a), from Art. 43, § 797(c) and the first two
sentences of § 798(a), and from Art. 43, §
798(c).
Subsection (e) of this section is standard
language added to this and, where necessary,
corresponding sections of other titles of this
article. It states expressly a provision that
presently is only implied in the law — i.e.,
that the Board has a duty to renew the license of
a qualified licensee.
In subsection (a) of this section, the reference
to a May 31 expiration date is new language added
to conform to Board practice.
Subsection (b) of this section — which provides
for renewal notice — includes new language added
to conform to current Board practice and to
similar provisions governing other health
occupations in present Art. 43. See, e.g., Art.
43, § 634(c), as to psychologists, and Art. 43, §
868(d), as to social workers.
In subsection (c)(1) and (3)(i) of this section,
standard language is added to this and, where
necessary, corresponding sections of other titles
of this article to state expressly provisions
that presently are only implied in the law: i.e.,
that (1) other licensing requirements of this
title apply to any renewal under this section;
and (2) applications for renewal may be made only
on the form required by the Board.
Subsection (d) of this section is revised to
clarify that the Board has a duty to establish
rules and regulations for continuing education
requirements.
The third sentence of present Art. 43, § 798(a)
which provides that, if the licensee fails to
renew the license by the end of a 30-day grace
period, the Board "may suspend" the license — is
deleted as unnecessary and as in conflict with
