FOR the purpose of clarifying that certain provisions of the
alcoholic beverages laws shall only apply to certain
Garrett County liquor licenses as long as the County
Liquor Control Board maintains County Liquor
Dispensaries; clarifying language; relating generally
to Garrett County Liquor Dispensaries; and making this
Act an emergency measure.

BY repealing and reenacting, with amendments,

Article 2B - Alcoholic Beverages

Section 19(m)(4), 20(h-l)(v), 21(f-2)(2), 52(b),

69(d-l)(2), and 161(a-1)
Annotated Code of Maryland
(1981 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 2B - Alcoholic Beverages

19.

(m) (4) [Provided, that a restaurant or hotels] IF THE
GARRETT COUNTY LIQUOR CONTROL BOARD MAINTAINS COUNTY LIQUOR
DISPENSARIES, THE LICENSEES shall purchase the liquor or
wines sold by them from the Garrett County liquor [control
board] DISPENSARIES, and shall be charged the LIQUOR
DISPENSARY'S invoice price [of the liquor control board
plus], freight charges [on it], and [plus] 20 percent of an
aggregate invoice price and freight charges from time to
time.

20.

(h-1) (v) It shall be the duty of the Garrett County
liquor control board before issuing any license hereunder to
determine whether the business to be operated by the
prospective licensee is likely to enhance the recreational,
business and economic development of the county. If the
liquor control board in its discretion determines that the
issuance of such a license will not enhance such development
within the county, it shall reject the application for such
license.

[Provided that any such club or organization] IF THE
GARRETT COUNTY LIQUOR CONTROL BOARD MAINTAINS COUNTY LIQUOR
DISPENSARIES, THE LICENSEES shall purchase all liquor and
wines from the Garrett County liquor [control board]
DISPENSARIES, and shall be charged [therefor,] the LIQUOR
DISPENSARY'S invoice price [of the liquor control board
plus], freight charges [thereon], and [plus] 20 percent of
[such] THE aggregate invoice price and freight charges from
time to time.
