(2) THE BOARD SHALL CERTIFY AN INDIVIDUAL ON
INACTIVE STATUS WHO APPLIES FOR CERTIFICATION AND MAY NOT
REQUIRE PAYMENT OF A LATE FEE BY THE INDIVIDUAL AS A
CONDITION TO CERTIFICATION AT THAT TIME.

(B) REINSTATEMENT OF EXPIRED CERTIFICATION.

THE BOARD SHALL REINSTATE THE CERTIFICATION OF AN
INDIVIDUAL WHO HAS NOT BEEN PUT ON INACTIVE STATUS AND WHO
HAS FAILED TO RENEW THE CERTIFICATION FOR ANY REASON IF THE
INDIVIDUAL:

(1)  MEETS THE RENEWAL REQUIREMENTS OF § 16-309
OF THIS SUBTITLE; AND

(2)  PAYS TO THE BOARD A REINSTATEMENT FEE EQUAL
TO THE SUM OF:

(I)  THE REGULAR RENEWAL FEE SET BY THE
BOARD; AND

(II)  A LATE FEE EQUAL TO 10 PERCENT OF THE
REGULAR RENEWAL FEE FOR EACH MONTH OR FRACTION OF A MONTH
THAT THE CERTIFICATION IS EXPIRED, BUT NOT MORE THAN 100
PERCENT OF THE REGULAR RENEWAL FEE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the last clause
of the fourth sentence and the entire fifth and
sixth sentences of Art. 43, § 634(c).

Subsection (a)(l)(i) of this section is new
language added to state expressly that the Board
may require an applicant for inactive status to
use a particular form. This power of the Board
clearly is included in its broad power to adopt
rules and regulations under present Art. 43, §
625 — now § 16-206(a) of this title. It is set
forth in this section for clarity.

16-311. CODE OF ETHICS.

(A)  IN GENERAL.

THE BOARD SHALL ADOPT A CODE OF ETHICS FOR
PSYCHOLOGISTS IN THIS STATE. THE CODE OF ETHICS SHALL BE
DESIGNED TO PROTECT THE PUBLIC INTEREST.

(B)  REQUIRED CONSIDERATIONS.

IN ADOPTING THE CODE OF ETHICS, THE BOARD SHALL
CONSIDER:

(1)  THE ETHICAL STANDARDS OF PSYCHOLOGISTS
PUBLISHED BY THE AMERICAN PSYCHOLOGICAL ASSOCIATION; AND

(2)  THE PROFESSIONAL CHARACTER OF PSYCHOLOGICAL
SERVICES.
