(C) PUBLIC HEARINGS.

IN ADOPTING THE CODE OF ETHICS, THE BOARD SHALL
ANNOUNCE AND HOLD PUBLIC HEARINGS ON THE SUBJECT.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, § 627.

16-312. DENIALS, REPRIMANDS, SUSPENSIONS, AND REVOCATIONS
— GROUNDS AVAILABLE.

SUBJECT TO THE HEARING PROVISIONS OF § 16-313 OF THIS
SUBTITLE, THE BOARD, ON THE AFFIRMATIVE VOTE OF A MAJORITY
OF ITS MEMBERS THEN SERVING, MAY DENY ANY APPLICANT
CERTIFICATION, REPRIMAND ANY CERTIFIED PSYCHOLOGIST, OR
SUSPEND OR REVOKE THE CERTIFICATION OF ANY CERTIFIED
PSYCHOLOGIST IF THE APPLICANT OR CERTIFIED PSYCHOLOGIST:

(1)  FRAUDULENTLY OR DECEPTIVELY OBTAINS OR
ATTEMPTS TO OBTAIN A CERTIFICATE FOR THE APPLICANT OR
CERTIFIED PSYCHOLOGIST OR FOR ANOTHER;

(2)  FRAUDULENTLY OR DECEPTIVELY USES A
CERTIFICATE;

(3)  IS CONVICTED OF AN OFFENSE THAT WOULD BE A
FELONY IF COMMITTED IN THIS STATE;

(4)  IS OR HAS BEEN ADDICTED TO ANY NARCOTIC OR
HABITUALLY INTOXICATED;

(5)  AIDS OR ABETS AN UNAUTHORIZED PERSON IN

USING THE AS A TITLE "PSYCHOLOGIST" OR DESCRIBING THE

SERVICES THAT PERSON PROVIDES BY USE OF THE WORDS
"PSYCHOLOGICAL", "PSYCHOLOGIST", OR "PSYCHOLOGY";

(6)  CONDUCTS THE PRACTICE OF PSYCHOLOGY
FRAUDULENTLY OR DECEITFULLY; OR

(7)  VIOLATES THE CODE OF ETHICS ADOPTED BY THE
BOARD UNDER § 16-311 OF THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
636(a), (b), and the seventh sentence of (c).

In the introductory language of this section, "a
majority of its members then serving" is
substituted for "a majority", for clarity.

Also in the introductory language of this
section, the phrase "deny any applicant
certification" is new language added to state
expressly a power that presently is only implied
— that the Board may deny certification to an
applicant who violates a disciplinary provision
under this section.
