The definition is stated in the infinitive form
to permit minor verb variations of the defined
phrase, without taking these variations out of
the scope of the definition.
The only other changes are in style.
REVISOR'S NOTE TO SECTION: The first clause of present
Art. 43, § 791(3), which defines "person", is
deleted as unnecessary in light of the definition
of "person" in § 1-101 of this article.
Present Art. 43, § 791(9) and (10), which defines
"financial interest" and "household member", is
deleted as unnecessary in light of the
definitions of "household member" and
"substantial financial interest" in § 1-101 of
this article.
Present Art. 43, § 791(5) and (7), which defines
"speech pathologist" and "the practice of speech
pathology", now appears in § 19-101 of this
article. See the General Revisor's Note to this
title.
Present Art. 43, § 791(8), which defines
"unethical conduct", now appears in § 2-313 of
this title. See the revisor's note to that
section.
2-102. SCOPE OF TITLE.
(A) OTHER PROFESSIONS NOT REGULATED.
(1) THIS TITLE DOES NOT LIMIT THE RIGHT OF AN
INDIVIDUAL TO PRACTICE A HEALTH OCCUPATION THAT THE
INDIVIDUAL IS AUTHORIZED TO PRACTICE UNDER THIS ARTICLE.
(2) THIS TITLE DOES NOT PROHIBIT AN INDIVIDUAL
FROM PRACTICING ANY OTHER PROFESSION THAT THE INDIVIDUAL IS
AUTHORIZED TO PRACTICE UNDER THE LAWS OF THIS STATE.
(B) ACTIVITIES AND SERVICES NOT LIMITED.
THIS TITLE DOES NOT LIMIT THE RIGHT OF A HEARING AID
DEALER TO FIT AND DEAL IN HEARING AIDS.
REVISOR'S NOTE: Subsection (a)(1) of this section is
new language added to reflect more accurately the
state of the present law and to conform to the
language used in similar provisions in other
titles of this article.
Subsections (a)(2) and (b) of this section are
new language derived without substantive change
from the last sentence of Art. 43, § 792(b) and
from Art. 43, § 792(e).
