HARRY HUGHES, Governor

65

In subsection (a)(2) of this section, the phrase
"authorized to practice" is substituted for
"licensed" to express the apparent intent of the
present provision by including those individuals
who are not licensed, but who otherwise are
entitled to practice their profession in this
State.

Present Art. 43, § 792(d) — which provides that
this title does not prevent a medical or
osteopathic physician from performing certain
acts related to audiology and speech pathology —
is deleted as unnecessary in light of the broad
provisions of subsection (a)(1) of this section,
which covers all health occupations licensed
under this article.

For the provisions that relate generally to
hearing aid dealers, see Art. 43, § 737 et seq.
of the Code.

SUBTITLE 2. STATE BOARD OF EXAMINERS FOR AUDIOLOGISTS.

2-201. BOARD ESTABLISHED.

THERE IS A STATE BOARD OF EXAMINERS FOR AUDIOLOGISTS IN
THE DEPARTMENT.

REVISOR'S NOTE: This section presently appears as the
first sentence of Art. 43, § 802(a).

It is set forth as a separate section for
emphasis.

The word "State" is added to the name of the
Board to achieve uniformity among the names of
the health occupation boards that this article
governs.

The law is silent on whether the State Board of
Examiners for Audiologists and the State Board of
Examiners for Speech Pathologists are in the
Department, even though the laws on all of the
other health occupation boards governed under
this article provide that those boards are in the
Department. To avoid any question of
jurisdiction, the phrase "in the Department" is
added to include the Board expressly as a unit in
the Department.

The only other changes are in style.

2-202. MEMBERSHIP.

(A) COMPOSITION.
