(1) PROVIDE THE BOOKS AND FORMS NECESSARY TO
CONDUCT THE EXAMINATIONS;
(2) CONDUCT THE EXAMINATIONS IN WRITING, BUT MAY
USE SUPPLEMENTARY ORAL AND CLINICAL EXAMINATIONS; AND
(3) EXCEPT AS OTHERWISE PROVIDED IN THIS
SUBSECTION, DETERMINE THE SCOPE, FORM, AND PASSING SCORE FOR
THE EXAMINATIONS.
(E) SUBJECTS OF EXAMINATION.
AN EXAMINATION GIVEN UNDER THIS SUBTITLE MAY INCLUDE
ONLY SUBJECTS NORMALLY TAUGHT AT AN ACCREDITED SCHOOL OR
COLLEGE OF PODIATRY OR CHIROPODY.
(F) PARTICIPATION BY CONSUMER MEMBER OF THE BOARD.
UNLESS AUTHORIZED BY THE BOARD, THE CONSUMER MEMBER OF
THE BOARD MAY NOT PARTICIPATE IN ANY ACTIVITY RELATED TO
EXAMINATIONS UNDER THIS SUBTITLE.
(G) RECORD OF EXAMINATION.
THE BOARD SHALL:
(1) ACT ON EACH EXAMINATION PROMPTLY; AND
(2) RECORD THE RESULTS OF EACH EXAMINATION IN
THE BOARD'S MINUTES.
REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
482(a)(5), the first and second sentences, the
first clause of the fourth sentence, and the
entire sixth through ninth sentences of § 483,
and the last sentence of § 487(a).
In subsection (c) of this section, the
requirement that the Board "shall notify each
qualified applicant of the time and place of
examination" is substituted for the present
reference to notice being given "as the Board may
deem proper", to avoid the erroneous implication
that the Board may provide less than what would
be considered the constitutionally required fair
notice.
In subsection (d)(3) of this section, standard
language is added to state expressly provisions
that presently are only implied in the law; e.g.,
that the Board shall determine the passing score
for the examinations that the Board gives.
In subsection (e) of this section, the words
"normally taught at an accredited school or
college of podiatry or chiropody" are substituted
