In subsection (b) of this section, present Art.
43, § 258(c)(1), which provides for the receipt
of applications for examinations and the issuance
of licenses, is deleted as redundant of §§ 12-303
and 12-306 of this title, which provide for
application for and issuance of licenses,
respectively.

Present Art. 43, § 258(d) (2), which provides that
the Board may "{d}emand and receive ... the
fees provided for in this subtitle" and which
provides for the disposition of these fees when
collected, is deleted as unnecessary in light of
independent provisions of this title. See, e.g.,
§ 12-206 of this subtitle and § 12-303 of this
title.

12-206. DISPOSITION OF FUNDS.

THE BOARD SHALL PAY ALL FUNDS COLLECTED UNDER THIS
TITLE INTO THE GENERAL FUND OF THIS STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the third
sentence of Art. 43, § 259.

The fourth sentence of present Art. 43, § 259,
which requires that disbursement of funds be in
accordance with Art. III, §§ 32 and 52 of the
State Constitution and Art. 15A, §§ 1 through 15
of the Code, which relate to disbursements from
the General Fund of this State, is deleted as
implicit in the requirement that the funds are
part of the General Fund of this State.

The second sentence of present Art. 43, § 268(e)
— which provides for the disposition of all
"permit" fees collected under the provisions of
present Art. 43, § 268 — is deleted as
inconsistent with and superseded by the general
provisions of this section and other independent
provisions of law.

SUBTITLE 3. LICENSING.

12-301. LICENSE REQUIRED; EXCEPTION.

(A)  IN GENERAL.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, AN
INDIVIDUAL SHALL BE LICENSED BY THE BOARD BEFORE THE
INDIVIDUAL MAY PRACTICE PHARMACY IN THIS STATE.

(B)  EXCEPTION.

THIS SECTION DOES NOT APPLY TO AN INDIVIDUAL WHILE
ENGAGING IN A CLINICAL PHARMACY TRAINING PROGRAM UNDER THE
DIRECT SUPERVISION OF A LICENSED PHARMACIST.
