(I)  METHODS OF ADVERTISING AND PROMOTION;
AND

(II)  STANDARDS FOR FILLING AND REFILLING
PRESCRIPTIONS.

(B) DUTIES.

IN ADDITION TO THE DUTIES SET FORTH ELSEWHERE IN THIS
TITLE, THE BOARD SHALL:

(1)  KEEP A RECORD THAT INCLUDES:

(I)  THE NAME AND PLACE OF BUSINESS OF EACH
LICENSED PHARMACIST; AND

(II)  THE FACTS CONCERNING THE ISSUANCE OF
THAT PHARMACIST'S LICENSE; AND

(2)  PREPARE AND DELIVER TO THE GOVERNOR, THE
SECRETARY, AND THE MARYLAND PHARMACEUTICAL ASSOCIATION AN
ANNUAL REPORT THAT:

(I)  SUMMARIZES THE CONDITION OF PHARMACY
IN THIS STATE;

(II)  INCLUDES A RECORD OF THE PROCEEDINGS
OF THE BOARD; AND

IS LICENSED.

(III) LISTS EACH PHARMACIST WHO CURRENTLY

REVISOR'S NOTE: This section is new language derived
without substantive change from Art. 43, §
258(c) through (e) and from the first half of the
second sentence of Art. 43, § 268(c).

In subsection (a) of this section, the present
requirement that the rules and regulations be
adopted "in accordance with the Administrative
Procedure Act" is deleted as needlessly
repetitive of independent requirements of law.

Subsection (a)(2) of this section states the
general power of the Board to adopt rules and
regulations to carry out the provisions of this
title. The provision is founded in the present,
more specific, provisions of Art. 43, §§ 258(e)
and 268(c), which provide rulemaking power to set
standards for practicing pharmacy and operating
pharmacies and to carry out and enforce all of
the provisions concerning the establishment and
operation of pharmacies. The new language states
the general rulemaking power of the Board in a
manner similar to comparable provisions of other
titles of this article.
