REVISOR'S NOTE: This subsection is new language derived
without substantive change from Art. 43, §
250(a)(1), as that item relates to devices, and
the second paragraph of (5).

As this definition is presently organized, its
application appears to be limited to the
definition of "practice pharmacy", which now
appears in subsection (j) of this section.
However, since the term "device" has a meaning in
this title independent of the definition of
"practice pharmacy", it now appears as an
independent subsection of this section.

The second paragraph of present Art. 43, §
250(a)(5) defines both "drug" and "devices".
Given the totally exclusionary approach of that
definition, the term "drug" is deleted as
unnecessary; the excluded items, which now appear
as paragraph (2)(i) through (iv) of this
subsection, obviously apply only in regard to
devices.

(E)  LICENSE.

"LICENSE" MEANS, UNLESS THE CONTEXT REQUIRES OTHERWISE,
A LICENSE ISSUED BY THE BOARD TO PRACTICE PHARMACY.

REVISOR'S NOTE: This subsection is new language added
to avoid needless repetition of phrases such as
"license to practice pharmacy".

(F)  LICENSED PHARMACIST.

"LICENSED PHARMACIST" MEANS, UNLESS THE CONTEXT
REQUIRES OTHERWISE, A PHARMACIST WHO IS LICENSED BY THE
BOARD TO PRACTICE PHARMACY.

REVISOR'S NOTE: This subsection is new language added
to avoid needless repetition of phrases such as
"individual licensed to practice pharmacy".

On occasion, the term "licensee" is used in this
title as a synonym for "licensed pharmacist".
Since "license" is defined in subsection (e) of
this section, "licensee" need not be defined
separately.

(G)  PHARMACIST.

"PHARMACIST" MEANS AN INDIVIDUAL WHO PRACTICES
PHARMACY.
