REVISOR'S NOTE: This subsection is new language added
to provide an express definition of "pharmacist";
it is stated in the standard form used to define
the various health practitioners regulated under
this article.

(H) PHARMACY.

"PHARMACY" MEANS AN ESTABLISHMENT IN WHICH:

(1)  DRUGS, MEDICINES, OR DEVICES ARE DISPENSED,
SOLD, OR OFFERED FOR SALE; OR

(2)  A PERSON OTHERWISE PRACTICES PHARMACY.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from Art. 43, §
250(b)(1) and (2).

The reference to "devices" is added to item (1)
of this subsection in conformity with the usual
trilogy of "drugs, medicines, or devices" used
throughout this title. See the General Revisor's
Note to this title.

Present Art. 43, § 250(b)(3), which refers to the
compounding or dispensing of prescriptions, is
deleted as unnecessary in light of item (2) of
this subsection. See the definition of "practice
pharmacy" in subsection (j) of this section.

Present Art. 43, § 250(b)(4), which relates to
the use of certain terms and symbols, now appears
in § 12-704 of this title.

(I) PHARMACY PERMIT.

"PHARMACY PERMIT" MEANS A PERMIT ISSUED BY THE BOARD TO
ESTABLISH AND OPERATE A PHARMACY.

REVISOR'S NOTE: This subsection is new language added
to avoid needless repetition of phrases such as
"permit to operate a pharmacy".

(J) PRACTICE PHARMACY.

(1) "PRACTICE PHARMACY" MEANS TO ENGAGE IN ANY
OF THE FOLLOWING ACTIVITIES:

(I)  SELECTING, PREPARING, AND DISPENSING
DRUGS, MEDICINES, OR DEVICES;

(II)  PROVIDING INFORMATION AND EXPLANATION
TO PATIENTS AND HEALTH CARE PRACTITIONERS ABOUT THE SAFE AND
EFFECTIVE USE OF DRUGS, MEDICINES, OR DEVICES; OR
