(5) INVESTIGATE ANY ALLEGED VIOLATION OF THIS
TITLE AND, IF THE RESULTS OF THE INVESTIGATION INDICATE THAT
THE ALLEGATION HAS MERIT, REPORT IT TO THE STATE'S ATTORNEY
OF THE COUNTY WHERE ANY ALLEGED VIOLATION OCCURRED;
(6) ENFORCE THE PROVISIONS OF THIS TITLE; AND
(7) INCUR ANY NECESSARY EXPENSE IN ACCORDANCE
WITH THE STATE BUDGET FOR THE INVESTIGATION AND PROSECUTION
OF ANY ALLEGED VIOLATION OF THIS TITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from the eighth
sentence of Art. 43, § 471 and the reference to
the Board seal in the second sentence and the
first clauses of the third and fourth sentences
of § 473 and from Art. 43, § 480(d).
In items (5), (6), and (7) of this section, the
references in present Art. 43, § 480 to
investigate alleged violations, incur expenses,
and enforce this subtitle are impractical for the
Board secretary to perform and contrary to the
current practice of the Board. Therefore, these
provisions are revised as duties of the Board.
In item (5) of this section, the reference to
reporting allegations to the State's attorney is
substituted for the inaccurate reference to the
Board instituting prosecutions. See Art. 10, §
34 of the Code, which provides that the State's
attorney prosecutes for this State.
In item (7) of this section, the phrase "in
accordance with the State budget" is substituted
for the present reference to the Board paying
expenses out of Board funds in light of the
current State funding mechanism.
The ninth sentence of present Art. 43, § 471,
which refers to the use of the record and
register as "prima facie" evidence, is deleted as
unnecessary in light of CJ § 10-204, which
provides generally for the use of records in
court.
11-206. DISPOSITION OF FUNDS.
THE BOARD SHALL PAY ALL FUNDS COLLECTED UNDER THIS
TITLE INTO THE GENERAL FUND OF THIS STATE.
