accordance with Art. III, §§ 32 and 52 of the
State Constitution and Art. 15A, §§ 1 through 15
of the Code, both of which relate to
disbursements from the General Fund of this
State, is deleted as implicit in the requirement
that the funds are part of the General Fund of
this State.

SUBTITLE 3. LICENSING.

11-301. LICENSE REQUIRED.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, AN
INDIVIDUAL SHALL BE LICENSED BY THE BOARD BEFORE THE
INDIVIDUAL MAY PRACTICE OSTEOPATHY IN THIS STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause
of Art. 43, § 479 and rephrased in the standard
language used throughout this article to state
affirmatively that an individual must be licensed
to practice a health occupation in this State.

11-302. QUALIFICATIONS OF APPLICANTS.

(A)  IN GENERAL.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, TO QUALIFY
FOR A LICENSE, AN APPLICANT SHALL BE AN INDIVIDUAL WHO MEETS
THE REQUIREMENTS OF THIS SECTION.

(B)  MORAL CHARACTER.

THE APPLICANT SHALL BE OF GOOD MORAL CHARACTER.

(C)  AGE.

THE APPLICANT SHALL BE AT LEAST 18 YEARS OLD.

(D)  EDUCATION.

THE APPLICANT SHALL HAVE A DEGREE OF DOCTOR OF
OSTEOPATHY FROM A COLLEGE OR UNIVERSITY ACCREDITED BY THE
AMERICAN OSTEOPATHIC ASSOCIATION, WHICH DEGREE REQUIRES AT
LEAST 3 YEARS OF PREPROFESSIONAL STUDY AND 4 YEARS OF
GRADUATE PROFESSIONAL STUDY.

(E)  EXAMINATION.

EXCEPT AS OTHERWISE PROVIDED IN THIS TITLE, THE
APPLICANT SHALL PASS AN EXAMINATION GIVEN BY THE BOARD UNDER
THIS SUBTITLE.
