Chapter 59
AN ACT to repeal and reenact with amendments Chapter
11A, title "Condominiums", of the Montgomery County Code,
1972, as amended; Section 11A-2, title "Definitions" to
redefine conversion; Section 11A-3, title "Property Report
Required, Contents of Report" to allow the Office of
Consumer Affairs to request additional material information;
Section 11A-4, title "Submission of Property Report to
Prospective Purchaser, Filing of Report With Office of
Consumer Affairs; Recission of Contract of Sale" to require
the developer to notify the affected tenants of the filing
of the property report with the Office of Consumer Affairs,
to require a filing fee accompanying the property report, to
have the Office of Consumer Affairs acknowledge receipt of
filing, to have any additional requests made within thirty
days of receipt, to have the Office of Consumer Affairs
accept or reject the report within sixty (60) days of
receipt, if rejected to state reasons and to accept or
reject any resubmitted reports within thirty (30) days;
Section 11A-6, title "Budgeted Reserves" to require that the
developer annually budget for repair and replacement of
common elements; Section 11A-7, title "Notice to Tenants of
Status Conversion; Right of Tenant to Terminate Lease;
Liability for Relocation Costs; Inability To Enter Into
Contracts For Sale For Specific Period Of Time; Date When
Section Null and Void" to provide tenants the right to
terminate leases after receipt of notice of intent to
convert; Section 11A-8, title "Tenants Right of First
Refusal" to provide resident of converting unit a right of
first refusal on dwelling unit for sixty (60) days; Section
11A-9, title "Right of First Refusal for Certain
Organizations Prior to Transfer of Rental Facilities" to
require the owner of converting property to disclose
particular information; Section 11A-11, title "Complaints,
Penalties, Enforcement" to establish a penalty for failure
to fulfill an obligation imposed by this Chapter; and to
conform the numbering of each Section.
