Chapter 54

AN EMERGENCY ACT to amend Chapter 49, title "Streets
and Roads", of the Montgomery County Code, 1972, as amended,
by repealing Section 49-24A, title "Accumulation of snow and
ice on sidewalks, walkways and pathways from parking areas
prohibited" and reenacting a new Section 49-24A, title
"Accumulation of snow and ice on commercial, multi-family
and industrial property prohibited"; to provide that owners
and managers of commercial and multi-family properties, and
industrial properties in commercial and office use, shall be
jointly and severally responsible for removing snow and ice,
to the extent necessary to provide safe pedestrian pathways
(1) between parking areas on those properties and entrances
to the buildings and (2) between stopping points for bus
transportation and entrances to the buildings; to further
provide that if an owner or manager is unable to remove ice
or hardpacked snow from a sidewalk, walkway or pathway that
sand or salt be used; to further provide that this Section
be enforced by the Police Department; to further provide
authority for the County Executive to use discretion in
issuing orders to modify the time and conditions for
clearing sidewalks and walkways under certain circumstances;
to further provide that any violation of this Section shall
constitute a misdemeanor punishable by a fine of fifty
dollars ($50.00); and to provide that this Section shall
apply throughout the County except within the corporate
limits of any incorporated city, village or town possessing
the authority to adopt snow removal legislation unless the
incorporated city, village or town adopts this Section and
requests that the County enforce its provisions.

Chapter 55

AN EMERGENCY ACT to add Article VII, title "Condominium
Conversion Emergency Aid Fund" to Chapter 56, title "Urban
Renewal and Community Development" of the Montgomery County
Code, 1972, as amended, to declare a public purpose, to
authorize the creation of a special fund for assistance to
households of elderly or handicapped individuals whose
relocation is threatened by the conversion of a rental
facility to condominium status, to establish the maximum
grant allowable under this fund, to establish loans secured
by second trust documents, to require Executive Regulations
to be issued to implement the program, and to declare the
program to cease to have effect four years from date of
enactment.
