Chapter 52

AN EMERGENCY ACT to amend Chapter 11A, title
"Condominiums" of the Montgomery County Code, 1972, as
amended, by repealing and reenacting with amendments Section
11A-5C, tile "Transfer of Rental Facilities" to provide a
pretransfer procedure to permit tenants' organizations, the
Montgomery County Housing Opportunities Commission and
Montgomery County an opportunity to purchase the facilities
under certain conditions, to set forth certain penalties for
violating the provisions of this Section; and to provide for
the termination of this Section on September 1, 1980.

Effective Date January 30, 1980.

Chapter 53

AN EMERGENCY ACT to amend Article VI, title "Rent
Stabilization Act" of Chapter 29, title "Landlord-Tenant
Relations", Montgomery County Code, 1972, as amended,
Section 29-47, title "Legislative Findings and Intent", to
delete the establishment of a voluntary rent guideline;
Section 29-48, title "Definitions", to delete the definition
of inflation index; Section 29-55, title "Rent Adjustments
and Guidelines", to delete the voluntary rent guideline of
7.6 percent and the method of calculation of subsequent
voluntary rent guideline percentages, to establish a maximum
rental increase of ten percent (10%), to delete the
averaging method of calculating rent increases for purposes
of determining compliance; Section 29-56, title "Notice
Requirements Applicable to Rent Adjustment", to delete
reference to the averaging method and to eliminate reporting
requirements for landlords with less than twelve rental
units; Section 29-62, title "Commission Hearings", to
establish appeal rights for tenants in those cases where the
Executive Director does not conduct a public fact-finding
hearing and finds the extraordinary rent increase justified;
and to make certain other technical changes.

Effective Date January 30, 1980.
