Chapter 29

AN EMERGENCY ACT to amend Chapter 26, title "Housing
Standards" of the Montgomery County Code 1972, as amended,
by repealing and reenacting with amendments Section 26-1,
title "Definitions", Section 26-4, title "Inspections
generally; when warrants required; right of entry of
inspectors and owners", Subsection (g) of Section 26-6,
title "Minimum standards for light, ventilation and
heating", Subsection (j) of Section 26-8, title "General
requirements relating to safe and sanitary maintenance of
parts of dwellings and dwelling units", Subsection (d) of
Section 26-9, title "Minimum space, use and location
requirements", Subsection (g) of Section 26-10, title
"Responsibilities of owners and occupants", Subsection (c)
of Section 26-11, title "Hostels, boardinghouses, rooming
houses and tourist homes", Section 26-12, title "Designation
of unfit dwellings and legal procedure of condemnation",
Section 26-13, title "Housing board of review", Section
26-14, title "Notice of violation and order to comply with
chapter; appeal to housing board of review", Section 26-15,
title "Appeal from decisions of housing board of review",
Section 26-16, title "Waivers or variances from chapter",
Section 26-18, title "Repair or removal of condemned
buildings", Section 26-19, title "Emergency actions", and
Subsection (d) of Section 26-21, title "Smoke detectors", to
transfer the functions of the Director of the Department of
Environmental Protection and the Health Officer under this
chapter to the Chief Administrative Officer of Montgomery
County, Maryland or his designee by deleting all references
to the Director of the Department of Environmental
Protection and the Health Officer and substituting therefor
the Chief Administrative Officer of Montgomery County,
Maryland, and by deleting the definition of "Health Officer"
and providing a definition of "Chief Administrative
Officer"; and certain other technical changes.

Effective Date December 28, 1979.

AN EMERGENCY ACT to amend Chapter 28, title "Junk
Dealers and Junk Yards", of the Montgomery County Code 1972,
as amended, by repealing and reenacting with amendments
Section 28-2, title "Licenses", to transfer the licensing
function from the Department of Environmental Protection to
the Department of Health.
