days after the fourth publication of the notice in the
aforementioned newspaper.

RESOLUTION NO. 5-80

A RESOLUTION AND ORDINANCE TO AMEND THE TOWN CHARTER TO
PROVIDE FOR THE ANNEXATION TO THE TOWN OF DELMAR, MARYLAND,
OF AN ADDITIONAL AREA OF LAND PURSUANT TO A DULY AUTHORIZED
AND CERTIFIED PETITION OF MORE THAN TWENTY-FIVE PER CENTUM
(25%) OF THE PERSONS WHO RESIDE IN THE AREA PROPOSED TO BE
ANNEXED AND WHO ARE REGISTERED AS VOTERS IN COUNTY ELECTIONS
IN THE PRECINCT OR PRECINCTS IN WHICH THE TERRITORY TO BE
ANNEXED IS LOCATED AND BY THE OWNERS OF NOT LESS THAN
TWENTY-FIVE PER CENTUM (25%) OF THE ASSESSED VALUATION OF
REAL PROPERTY LOCATED IN THE AREA TO BE ANNEXED.

WHEREAS, the Mayor and Commissioners of Delmar have
received a written petition signed by not less than
twenty-five per centum (25%) of the persons who reside in an
area proposed to be annexed to the Town of Delmar, Maryland,
and who are registered as voters in County elections in the
precinct or precincts in which the territory to be annexed
is located, and by the owners of not less than twenty-five
per centum (25%) of the assessed valuation of the real
property located in the area to be annexed; and

WHEREAS, upon presentation of said petition, the
presiding officer of the Town of Delmar has caused to be
made a verification of the signatures thereon and has
ascertained that the persons signing the petition represent
at least twenty-five per centum (25%) of the persons who
reside in the area to be annexed and who are registered as
voters in County elections in the precinct or precincts in
which the territory to be annexed is located and constitute
the owners of twenty-five per centum (25%) of the assessed
valuation of the real property located in the area to be
annexed.

[Section DC 3-1 of the Code of Public Local Laws of
Wicomico County, added.
