VETOES

(C) (1) THE DEPARTMENT MAY ENTER INTO CONCESSION
MANAGEMENT AGREEMENTS WITH ANY PERSON PROVIDED THAT THE
CONCESSION IS LOCATED ON STATE LAND MANAGED BY THE
DEPARTMENT FOR PURPOSES OTHER THAN NATURAL ENVIRONMENTAL
AREAS, SCENIC RIVERS, OR HISTORIC SITES AND THE CONCESSION
AGREEMENT IS GRANTED IN ACCORDANCE WITH PROCEDURES APPROVED
BY THE BOARD OF PUBLIC WORKS AND IS APPROVED BY THE BOARD OF
PUBLIC WORKS.

(2)  THE DEPARTMENT MAY SUBMIT A CONCESSION
MANAGEMENT AGREEMENT TO THE BOARD OF PUBLIC WORKS FOR
APPROVAL ONLY AFTER THE DEPARTMENT HAS COMPLETED AN
ENVIRONMENTAL AND ECONOMIC ASSESSMENT OF THE IMPACT OF THE
PROPOSED CONCESSION ON THE SITE AND SURROUNDING AREAS AND
THE DEPARTMENT HAS DETERMINED THAT THE PROPOSED CONCESSION
FACILITY HAS NO SIGNIFICANT ADVERSE IMPACT ON THE PHYSICAL
OR SOCIOECONOMIC ENVIRONMENT OF THE CONCESSION SITE OR THE
SURROUNDING AREAS.

(3)  ANY CONCESSION MANAGEMENT AGREEMENT GRANTED
BY THE DEPARTMENT SHALL BE COMPATIBLE WITH THE NATURAL
FEATURES OF THE AREA AND THE OTHER USES OF THE AREA.

5-210.1.

(A) THE DEPARTMENT SHALL:

(1) DEVELOP A CONCESSION MANAGEMENT PROGRAM
WITH EXISTING STATE PERSONNEL TO STUDY, EVALUATE, AND PLAN
THE MOST SUITABLE SITES FOR ESTABLISHMENT AND EXPANSION OF
CONCESSIONS;

(2) INVENTORY ALL LANDS MANAGED BY THE

DEPARTMENT TO DETERMINE WHICH LANDS ARE MOST SUITABLE FOR
THIS PURPOSE; AND

(3) PREPARE A PLAN FOR DEVELOPMENT OF ANY LANDS
SELECTED; AND

(4) REQUEST THE LOCAL GOVERNING BODY TO APPOINT
A LOCAL ADVISORY COMMITTEE TO REVIEW AND COMMENT ON ANY
PLANS FOR CONCESSION DEVELOPMENT OR EXISTING SERVICE WITHIN
ITS JURISDICTION.

(B) THE CONCESSIONS MANAGEMENT PROGRAM SHALL ENCOURAGE

PRIVATE INVESTMENT IN DEVELOPMENT, CONSTRUCTION, AND

OPERATION OF ALL TYPES OF CONCESSIONS, INCLUDING CABINS,
LODGES, SCENIC TRAILS, RESORT TYPE COMPLEXES, GOLF COURSES,
AND OTHER FACILITIES, IF THE DEPARTMENT DETERMINES THAT THE
INVESTMENT IS IN THE BEST INTEREST OF THE PUBLIC.

(C) IN PREPARATION AND DEVELOPMENT OF THE PLAN AND
PROGRAM FOR EACH CONCESSION, THE DEPARTMENT SHALL:
